1. Scope of Services and Ancillary Activities
THE WINE WOMAN d.o.o., Split, Croatia (hereinafter TWW) operates as an independent consultancy and advisory company focused on Croatia related travel insights, gastronomy, and wine culture.
TWW provides informational and experiential advice, shares professional knowledge about Croatian destinations, food, and wine, and connects clients with independent third parties such as licensed travel agencies, tour operators, wineries, small agricultural producers, restaurants, and bars. TWW does not itself provide transport, accommodation, catering, or tourism services within the meaning of Croatian tourism legislation.
Main services that TWW provide are:
Advisory & Consulting: Providing travel advice about Croatia, including food and wine recommendations.
Facilitation: Provides contacts to third-party providers such as travel agencies, tour operators, local wineries, small farmers, restaurants, and bars.
Event Organization: Organizing food and wine tasting events at third-party venues (wineries, restaurants, bars).
In addition to advisory services, TWW may perform ancillary organizational activities of a supportive nature, such as facilitating introductions, or assisting with scheduling tastings. These activities are secondary and are performed exclusively to support the advisory relationship, without constituting independent tourism services or bundled travel arrangements.
2. Legal Qualification and Exclusion of Package Travel Services
The parties expressly acknowledge that TWW acts solely as an advisor and facilitator and not as a package travel organizer or travel agency within the meaning of the Act on the Provision of Tourism Services and Directive (EU) 2015/2302. TWW does not combine or sell transport, accommodation, or other tourist services for a single total price, nor does it assume responsibility for the execution of such services.
Any fees paid to TWW represent remuneration for consulting, advisory work, and organizational coordination performed by TWW. Such payments do not constitute advance payments for travel services. All bookings and payments for travel, accommodation, tastings, meals, or other services recommended by TWW are concluded directly between the client and the respective third party.
3. Reservations, Payments, and Cancellation Policy
Consultations and participation in tastings or similar events are considered reserved only upon receipt of the agreed fee by TWW or the respective third-party service provider. Until payment is received, TWW reserves the right to offer the same time slots or places to other clients.
Given the personalized and preparatory nature of TWW's services, fees are generally nonrefundable once the (consulting, organisational or other) service has been performed in whole or in part. Where services have not yet been performed, refunds may be limited to the extent permitted by applicable law, unless different cancellation and refund conditions are expressly stated at the time of booking. Nothing in these Terms limits mandatory consumer rights under Croatian or EU law.
If TWW is required to cancel an activity due to circumstances beyond its reasonable control, TWW's liability is limited to refunding the fee paid directly to TWW. TWW shall not be liable for any additional costs incurred by the client, including travel, accommodation, or third-party services.
4. Third Party Services and Limitation of Liability
Any third-party services introduced or recommended by TWW are provided by independent entities acting in their own name and on their own responsibility. TWW does not act as an agent, guarantor, or representative of such third parties.
TWW shall not be liable for the quality, safety, legality, or performance of services provided by third parties, nor for any damage, loss, or injury arising from their activities. Any claims relating to third party services must be addressed directly to the respective provider.
This limitation of liability does not apply in cases of intent or gross negligence on the part of TWW, nor where liability cannot be excluded under mandatory law.
5. Alcohol Consumption, Age Requirements, and Conduct
Participation in events involving alcohol consumption is strictly limited to persons who are at least 18 years of age. TWW does not serve alcohol and does not act as a catering provider. Alcohol is served exclusively by licensed venues or producers.
Participants may be required to present valid identification. In cases of inappropriate conduct, intoxication, or behavior that endangers others or disrupts the event, TWW or the venue reserves the right to deny participation without any right to refund. Clients remain solely responsible for their personal conduct and alcohol consumption.
6. Health Information and Dietary Requirements
Clients are responsible for informing TWW and relevant third parties of any allergies, medical conditions, or dietary requirements in a timely manner. While TWW may forward such information to partners, it does not guarantee that specific requirements can be accommodated. If TWW does not provide a guarantee in writing beforehand, it is the obligation of the Client to check with the respective third parties on a case-by-case basis if their dietary and/or health requirements can be met.
TWW shall not be liable for adverse health effects resulting from incomplete information provided by the client or failures by third parties to meet communicated requirements.
7. Photography, Video Recording, and Data Protection
To promote our community and services, TWW often takes photographs and videos during events. We strictly adhere to the following rules:
Legitimate Interest: Based on our legitimate interest in documenting and marketing our events (GDPR Art. 6(1)(f)), we may capture your image in a group setting.
Explicit Consent: For close-up shots or featured promotional content, we will request your verbal or written consent on-site.
Right to Object: You may inform the photographer at the start of any event if you do not wish to be photographed. You may also request the removal of any photo of yourself from our digital platforms at any time by emailing info@thewinewoman.com.
Minors: We will never publish photos of minors without the explicit written consent of a parent or guardian.

8. Governing Law and Jurisdiction
These Terms and Conditions are governed by the laws of the Republic of Croatia. Jurisdiction shall lie with the competent courts in Split Croatia, provided that such jurisdiction clause is permitted under applicable consumer protection and EU private international law rules.

Booking & Cancellation Policy and General Terms

1. MEMBERSHIP LEVELS
3-Month: 3 credits
6-Month: 6 credits
12-Month: 12 credits
2. MEMBERSHIP CREDITS
Refunds: You have 14 days from the date of purchase to change your mind and request a full refund, provided you haven't used any of the credits to book an event.
Transferring Unused Credits: Unused credits are fully transferable! If you can't use them, you can gift them to a friend or another member who is at least 18 years old.
To Refund or Transfer Unused Credits: Email us at info@thewinewoman.com with your order number andthe details of the transfer or to request a refund.
Credit Expiration: Credits expire 24 months from the date of purchase. We recommend using your credits within this timeframe. If you have questions about your expiration date, contact info@thewinewoman.com.
3. BOOKING AN EVENT (ACTIVATING CREDITS)
The Commitment: You must book your spot for an event at least 7 days before the event. Once you use your credits to book a spot for a specific event date, that booking becomes final. Because we prep the wine and food and reserve a seat specifically for you, once an event is booked, it is non-refundable.
Event Transfers: If you've booked a spot but can't make it, you can send someone else in your place! Please let us know the name of your replacement at least 24 hours before the event starts. Email info@thewinewoman.com with your name and phone number (that is your unique account number) and the name, email, and phone number of the person taking your place.
4. GENERAL TERMS
Participation and Responsibility: You confirm you are at least 18 years old and agree to drink responsibly. By joining our events, you understand that alcohol consumption involves certain inherent risks, and you agree to behave in a way that keeps yourself and others safe. This does not limit your statutory consumer rights.
Website Terms: By signing, you acknowledge that the full General Terms and Conditions and Privacy Policy (found at Terms & Conditions) apply to this membership.
Personal Data: We process your name, birth date (for age verification and birthday membership benefits), email, phone number, and payment details to manage your membership and event bookings (legal basis: contract performance under GDPR Article 6(1)(b)). We retain this data for 11 years after your last purchase for accounting and legal compliance. Your data may be shared with payment processors (Stripe) and event venues as necessary.
